Not true. Yes you can fix it and keep it, but in most states once the threshold for "total loss" is met the car gets a salvage title regardless.

Im really hoping it gets totaled.. Something that is broken can never be new again no matter how good the repairmen is. I'll keep you guys updated on Monday since the insurance is closed on Sunday. I'm guessing the transmission got damaged too.. It won't go in reverse or park. Only neutral or drive. Somehow the high beam is stuck in the on position , but none of my lights work .

Sorry to see this. I went through a similar situation in December. My FR-S was parked on the street and a Drunk driver hit it me on the rear. Tore my rear driver side wheel off and had similar damage to the rear quarter panel and bumper. Took me about a month to get everything straightened out. One thing I would have done differently is pay my deductible and let my insurance company handle it. The girl who hit me had progressive and they were a pain in the ass to deal with. Even though she was 100% at fault they kept low balling me for 2 weeks. I had only had the car for 9 days and didn't have gap coverage. If it wasn't For Toyota bending over backwards to help me I would have been really screwed. Toyota Put my down payment towards the New FR-S and refunded me my warranty. It ended up costing me about $400 out of pocket. The Dealership also had a 10 series on year end closeout and gave me a killer deal. It took about a month to get everything finalized. But all is well now. Sucks to happen but sometimes things happen and you just have to make the best of it. Take this opportunity to think about the color you bought, MT maybe if you weren't happy with the AT like me, 2014, Monogram series. It could turn into a little bit of luck if you look on the bright side. Other drivers are idiots!!!!!

The claim office doesn't open till Monday. In your guys opinion, if its totaled what's a fair payout?
2014 Auto Scion FRS 510-520miles. Base, no options.

Don't accept shit lower than what you want. If they refuse to give lower than payout get a lawyer and sue the insurance company. It may take a while but in the end you will win and it will cost the insurance company far more than its worth.


My friend did this and walked away with everything paid + 19K in his pocket (that's after all fees including lawyer). Of course it took 2 years to get it but still. He would not even have sued if the insurance had not been trying to screw him.

I am amazed at this thread. I had a brand new Altima 3.5 and got rear ended by an idiot (in Arlington VA) at a stop light who barrelled into about 3 cars and his insurance company (All State) called me the next day. I expressed how frustrated I was about owning a brand new car that would never be the same and that I might get a lawyer and they ponied up the money fast. There was no problem getting an exact replacement Altima and I walked away with money in my pocket as did the other two people in my car.

And OP, go to the hospital ASAP. Even if you don't think it is anything serious now, it can be down the road and you need to get this documented.

Just a question thill, when they paid you, did you get all your money back? Loan + DP

I'm planning to ask their insurance to pay DP + my loan back. So it's 27k. Is that too much to ask for? Because me car is really essentially new...

1. Make sure you go through your insurance company forn the claim. They will probably refund your deductible if you ask as part of the final settlement. And they will represent you and do all the leg work for you. If the person that rearended you has the same insurance as you, contact a lawyer ASAP.
2. Most insurance major companies will give you the local replacement cost and not the value of your car. Do the research by asking your local dealers for written quotes for your specific vehicle. If you modified anything have receipts ready also.
3. To answer your question directly, the only fair payout is to get the same amount that it would cost you to buy a new one just like it.

The fact your car was three weeks old, a 2014, and had 514 miles is going to really help you. Good luck finding used cars out there that meet that criteria

If your car was 1-2 years old and had 30K miles, this would be a very different discussion.

You are in the drivers seat here since your car was basically a brand new car.

Damn. #3.. They will match my car to some used FRS that has over 10k miles locally. My FRS have 500miles. Locally they sell FRS for 22k 2013 model with about 15k miles. Oh well... I guess I'll just let insurance to see guesstimate the damage..
