Oh yea, you still have to make your car payment even if it is totaled. Don't worry though, every dollar you pay is one dollar less out of the payout check you owe.

Im surprised his car suffered minor damage.

I'm surprised how you can rear end someone at 40mph.. while the guy in front of you is full stop for good 10 seconds. I don't get people.

well lets hope you well not be upside down and I hope you scream neck pain when he rear ended you. Get a good attorney and sue his insurance is my best bet.

Thing is, I might still have to take money out my pocket if it's totaled... Because even though my car is new.. It's still 'used'

Now that i move my body, I'm feeling tiny bit of discomfort.

Let's say they total the car, they write you a check right? And you just pay it off, and then you can find a new car.

It looks really bad...looks like serious unibody damage in the rear.

I'd go to a hospital and get checked out... you've probably suffered some whiplash. Probably just the adrenaline causing you to not feel it.

If you want to feel better look up used frs in your area with less than 1k miles. They will offer you around that. If their are none, they have to base it on new car price. At the least you'll be right back where you started no car and. 6k in cash to put down on new one.

+1, go see a doc if you can tomorrow and have yourself checked out.

Also, by the looks of it, I'm sorry to say it but its a total loss. One quarter panel will cost roughly $4000 - 6000 to replace. Multiply by 2, not to mention other areas may be damaged such as your transmission.

Consider it a total loss, its really for the best.

Sorry for your loss. 500 miles and totaled, what a damn shame! For whatever reason, it's always those damn cocksuckers in them damn work trucks that drive way too fast and aggressive for their own good. Sue the hell out ta this chump. He deserves it!

If you put down what you said you did (~6K) you should be fine unless you paid some crazy amount for your vehicle.

I'm finding used FRS for ~$21.5K, which you can expect they will total the vehicle out at. So log as you owe this (or less) you'll be ok.

Ultimately, you're walking away healthy. I know it looks bad (and dont get me wrong, if it was my car I would be in tears), but remember - you were not at fault and you're ok.

If you dont get what you deserve, lawyer up. But in the end, you're ok. Stay positive, and good luck.
